Service Provider Agreement

1. Introduction

This Service Provider Agreement (“Agreement”) governs your registration and participation as a service provider (“Service Provider”, “you”, “your”) on www.quicksy.com.au (“Platform”).

Quicksy (“Quicksy”, “we”, “our”, or “us”) operates an online marketplace connecting customers with independent service professionals.

By registering as a Service Provider, you agree to be legally bound by this Agreement.

2. Independent Contractor Relationship

You acknowledge and agree that:

  • You are an independent contractor.

  • You are not an employee, agent, joint venturer, or partner of Quicksy.

  • Quicksy does not supervise or control how you perform services.

  • You are solely responsible for how services are delivered.

Nothing in this Agreement creates an employment relationship.

3. Eligibility Requirements

To register as a Service Provider, you must:

  • Be at least 18 years old.

  • Hold all required licences, permits, and qualifications.

  • Maintain a valid ABN (if applicable).

  • Maintain appropriate public liability insurance.

  • Comply with all Australian federal and state laws.

Quicksy may request documentation at any time.

4. Service Standards

You agree to:

  • Deliver services professionally and safely.

  • Honour confirmed bookings.

  • Arrive on time.

  • Communicate respectfully with customers.

  • Comply with workplace health and safety laws.

  • Provide accurate descriptions of your services.

Failure to meet standards may result in suspension or removal.

5. Fees & Commission

Quicksy may charge:

  • Commission on completed bookings.

  • Subscription or membership fees.

  • Transaction processing fees.

  • Promotional listing fees.

Fees will be disclosed via the platform.

Quicksy reserves the right to update fees with reasonable notice.

6. Payments
  • Customer payments may be collected through the Quicksy platform.

  • Quicksy may deduct applicable fees before payout.

  • Payout timelines may vary depending on processing providers.

  • You are responsible for tax obligations, including GST.

Quicksy is not responsible for payment delays caused by third-party processors.

7. Cancellations

7.1 Provider Cancellation

If you cancel a confirmed booking:

  • The customer will receive a full refund.

  • Repeated cancellations may result in penalties or suspension.

7.2 No-Shows

Failure to attend a confirmed booking may result in:

  • Account suspension.

  • Loss of platform access.

  • Withholding of pending payouts.

8. Insurance & Liability

You must maintain:

  • Public liability insurance.

  • Any legally required industry insurance.

You agree to indemnify and hold Quicksy harmless against:

  • Claims arising from your services.

  • Damage caused by you or your employees.

  • Injury, loss, or negligence related to your work.

Quicksy does not provide insurance coverage for your services.

9. Reviews & Ratings

Customers may leave reviews.

You agree that:

  • Reviews are part of the platform system.

  • Quicksy may remove inappropriate content.

  • Poor performance ratings may affect visibility or account status.

10. Anti-Circumvention (Very Important)

You agree not to:

  • Accept payment outside the platform for jobs sourced through Quicksy.

  • Encourage customers to bypass the platform.

  • Share direct payment details for the purpose of avoiding platform fees.

If you bypass the platform:

  • Quicksy may charge the applicable commission.

  • Your account may be suspended or permanently removed.

  • Legal action may be taken if necessary.

11. Compliance with Law

You agree to comply with:

  • Australian Consumer Law.

  • Tax obligations.

  • Workplace safety laws.

  • Licensing and industry regulations.

  • Anti - Circumvention

Quicksy may suspend accounts if legal non-compliance is suspected.

12. Intellectual Property

You grant Quicksy a non-exclusive licence to use:

  • Your business name.

  • Logo.

  • Profile image.

  • Service descriptions.

For marketing and platform display purposes.

13. Account Suspension & Termination

Quicksy may suspend or terminate your account if:

  • You breach this Agreement.

  • Fraudulent activity is suspected.

  • Customer complaints are repeated or serious.

  • You engage in unsafe or illegal conduct.

You may terminate your account by providing written notice.

14. Limitation of Liability

To the maximum extent permitted by law:

Quicksy is not liable for:

  • Loss of income.

  • Loss of future business.

  • Customer disputes.

  • Indirect or consequential damages.

Nothing in this Agreement excludes rights under Australian Consumer Law.

15. Dispute Resolution

If a dispute arises:

  1. Attempt resolution directly with the customer.

  2. Contact Quicksy support if necessary.

  3. Provide evidence upon request.

Quicksy may assist but is not obligated to resolve disputes.

16. Governing Law

This Agreement is governed by the laws of South Australia, Australia.

Disputes are subject to the jurisdiction of South Australian courts.

17. Changes to Agreement

Quicksy may update this Agreement at any time.

Continued use of the platform constitutes acceptance of the revised Agreement.
